New Laws for Condominium Meetings Held Via Video Conferencing

The condominium omnibus bill, which was adopted during the 2025 legislative session, amends Florida Statute 718.112 to explicitly allow condominium association meetings to be held by video conference. “Video conference” is defined in the statute to mean any real time audio and video meeting between two or more people via audio and video enabled devices. The law adds new notice requirements for all meetings held by video conference, as well as requirements for recording these meetings and requirements for retention of recordings as official records of the association. Each meeting held by video conference must also include a physical location for those attendees who choose to attend in person.

Any notice of meeting for a meeting held by video conference must state that the meeting is to be held via video conference and include a hyperlink, a conference telephone number for unit owners to attend the meeting by phone and provide the physical location of the meeting for in person attendance. All meetings conducted by video conference must be recorded and such recording must be maintained as an official record of the association. All video recordings or hyperlinks to all video recordings for all meetings of the board, meetings of the membership, or any committee meeting conducted by video conference must be maintained as an official record of the association and posted on the association website.

If the annual membership meeting is conducted by video conference, a quorum of the board must be physically present at the physical location of the meeting. Note that the requirement for a quorum of the Board only applies to the annual membership meeting, and not to a special meeting of the members. The new law does not explain what the consequences may be if the association does not have a quorum of its board physically in attendance at the annual meeting, but it instructs the Division to adopt rules expounding upon the new requirements for meetings by video conference. To date, the Division has not yet adopted such rules. If a meeting of the membership is conducted by video conference, the unit owner attendees may vote electronically in the same manner provided in the electronic voting statute, presumably through an electronic voting platform.
